  • A Joint Application is signed by both spouses and is typically faster. A Sole Application is signed by only one spouse and is personally served on the other spouse by someone outside the marriage. A Sole Application must be initiated by the spouse who currently resides in the Province/Territory that you want to file in and who has resided in that Province/Territory for a minimum of one year prior to starting a divorce proceeding.
  • Choose the Province/Territory based on the location of the spouse who is filing the divorce. Please keep in mind that the filer has to have resided in the Province/Territory of filing for a minimum of one year prior to starting a divorce proceeding.
  • Your first name must exactly match the name as shown on your Certificate of Marriage.
  • Your middle name(s) must exactly match the name(s) as shown on your Certificate of Marriage.
  • This is the last name you are currently legally using.
  • This address appears on your divorce documents and must be a residential address, not a PO Box or other mailing address.
  • Your spouse's full name must exactly match the name as shown on your Certificate of Marriage, including any middle name(s). The last name must be the name your spouse is currently legally using.
  • "This address will appear on your divorce documents and must be a residential address, not a PO Box or other mailing address. If you do not know the current address of your spouse, we suggest you try to locate your spouse as we cannot assist you if you can’t locate your spouse. A special ‘substitutional service order’ may need to be obtained to arrange for alternative service. This process is complicated and potentially expensive and you may want to talk to a family lawyer."
  • The place of marriage needs to match the place of marriage shown on your Certificate of Marriage.

    *Note Regarding Court Filing Fees*: Court filing fees will be billed after we have reviewed your information and are ready to file. Fee depends on your location of filing: BC $290, ON $587, MB $160, NB $110, NL $100, NS $74.85, SK $395, YK $150.

    You and/or your spouse may need your own copies of the Certificate of Divorce to remarry or for other matters where you must confirm and verify your divorce (ie: changing your name, property transfer, or a marriage abroad.) The cost is $125 for each copy and and will be billed separately.
